WEBSHOP REGULATIONS

- GENERAL PROVISIONS
- Online shop, operating at: https://houseofattractions.club/, based at: Ul. Siemiradzkiego 19/1, 31-137 Kraków, operating under NIP number: 6762522119.
- These Online Shop Regulations define the principles of making purchases in Roman Bondarenko's online shop, in particular the principles and procedure for concluding distance sales agreements through the Shop and the procedure for withdrawal from the agreement by the Consumer.
- With regard to Services provided by electronic means, these Regulations are the Regulations referred to in Article 9 of the Act on Provision of Services by Electronic Means of 18 July 2002 (ie. OJ 2020, item 344, as amended)
- The Terms and Conditions are addressed to all Customers of the Store. All Customers are obliged to familiarise themselves with the provisions of the Rules and Regulations before making a purchase.
- Each Customer is obliged to comply with the provisions of the Terms and Conditions. Sales are based on the version of the Terms and Conditions in force at the time the order is placed.
- Each Customer has the possibility to read the Rules and Regulations at any time by clicking on the hyperlink "Rules and Regulations of the Store" on the website of the Store https://houseofattractions.club/. The Rules and Regulations can be downloaded and printed at any time.
- All information contained on the Shop's website https://houseofattractions.club/ referring to products (including prices) do not constitute an offer within the meaning of Article 66 of the Civil Code of 23 April 1964 (i.e. Journal of Laws 2020, item 1740, as amended), but an invitation to conclude a contract, pursuant to Article 71 of the Civil Code of 23 April 1964 (i.e. Journal of Laws 2020, item 1740, as amended). By sending the Order Form, the Customer makes an offer to purchase the indicated Service at the price and under the conditions specified in the description.
- DEFINITIONS
Rules and Regulations - this set of regulations organising the principles of use of the Shop's Services by Customers. Consumer (contracts concluded before 1 January 2021) - a natural person, making a civil law contract through the Shop, not directly related to his/her business or professional activity. Consumer (contracts concluded from 1 January 2021 onwards) - the following are regarded as Consumers:
- a natural person making a civil law contract through
Shop, not directly related to its commercial or professional activity - the so-called "Consumer sensu stricto" and
- a natural person concluding a civil law contract through
Shop, directly related to his/her business activity, when it is evident from the content of this contract that it does not have a professional character for this person, in particular resulting from the subject of his/her business activity, made available on the basis of the provisions on the Central Register and Information on Business Activity - the so-called "Entrepreneur on the Rights of the Consumer".
For the purposes of these Terms and Conditions of Use, it is assumed that in the absence of a distinction between the two groups of entities indicated, the Terms and Conditions of Use shall refer to both Consumers stricto sensu and Entrepreneurs on the rights of Consumers.
Customer - a natural person (including a Consumer) who is at least 13 years of age (provided that he or she has obtained the consent of the legal representative), a legal person and an organisational unit that is not a legal person and to which special regulations grant legal capacity, who uses the Services provided by the Shop.
Order Form - a service available on the Shop's website, by means of which the Customer may make a purchase, in particular by adding Services to the Basket and specifying certain terms and conditions of the Sales Agreement, among others the method of delivery and payment.
Basket - an element of the Shop where the Services selected by the Customer are visible and where the Customer can determine and modify the Order data, including the quantity of Products purchased.
Shop - the website belonging to the Seller, available under the domain: https://houseofattractions.club/, through which the Customer may purchase Services from the Seller.
Seller - Roman Bondarenko with the registered office at: Ul. Siemiradzkiego 19/1 31-137 Kraków NIP: 6762522119, who, in the course of his commercial or professional activity, offers sales via his website.
Service - an economic activity of a non-productive nature, provided without
the simultaneous presence of the Seller and the Customer (at a distance), by means of a data transmission on the
at the individual request of the customer, transmitted and received by means of devices for
electronic processing, including digital compression, and data storage,
which is wholly transmitted, received or broadcast over a network
telecommunications within the meaning of the Act of 16 July 2004. - Telecommunications Law
(i.e. Journal of Laws 2021, item 576, as amended).
Sales Contract - a contract for the sale of Services at a distance concluded by the Customer via the Shop, usually via the Order Form.
- RECEIVING AND PROCESSING ORDERS
- A condition of using the Shop is reading and accepting these Terms and Conditions. By placing an order, the Customer accepts the content of the Terms and Conditions.
- Orders from Customers are accepted by means of a sent Order Form, made via the website: https://houseofattractions.club/ or by email to: houseofattractionskrakow@gmail.com, 7 days a week, 24 hours a day.
- The ordering of Services is carried out as follows:
Choose a ticket, click the 'Buy' button, select a payment method, accept the T&Cs.

The online payment service provider for card payments is Blue Media S.A.
- Traders, deemed to be so-called Traders with consumer rights (see definition of
"Consumer" in these Terms and Conditions), entering into contracts after 1 January 2021, will ,have to indicate, already at the time of ordering the Services, that the purchase is not for them
professional nature.
- Once the order has been placed, the Customer will receive a confirmation of the order placed to his/her e-mail address provided in the Order Form.
- Once the Customer has received confirmation of acceptance of the offer, the Seller's order fulfilment process begins, whereby:
- in the case of an order paid on delivery, it starts at the latest on the next working day after its confirmation by the Seller.
- in the case of an order paid by traditional bank transfer - begins after the payment for the placed order is credited to the Store's bank account.
- Orders placed in the Shop are processed 24 hours a day, regardless of the day of the week.
- The Customer will receive a message about acceptance of the order for fulfilment, which is understood to be the Seller's statement of acceptance of the offer. As soon as it is received, by the Customer, the Contract of Sale is concluded.
- A VAT receipt is issued with each order. A VAT invoice will also be sent upon request.

- The price stated in the order is the total value the customer is obliged to pay (gross price). It includes applicable tax.
- The Seller reserves the right to change the prices in the Shop, to introduce new Services for sale, to carry out and cancel promotional actions or to introduce changes in them, in accordance with the applicable legislation.
- If the Consumer is obliged to pay more than the agreed price described in the previous paragraph, the Shop shall immediately inform the Consumer of this fact, explaining the reason for the price difference. Charging the Consumer with additional costs shall only take place after obtaining the Consumer's express consent.
- IMPLEMENTATION OF PAYMENTS
- The following payment methods are possible within the operation of the Shop:

- The customer who has chosen the option of payment by bank transfer is obliged to pay for the order placed, within five (5) working days, from the date of placing the order.
Otherwise, the Seller's offer is not binding and the order is deleted from the system. In the title of the payment, it is sufficient to indicate only the number of the order being placed. There is the possibility of extending the payment deadline, with prior notification to the Shop staff.
- The above provisions do not exclude the Seller's ability to provide a guarantee for the purchased Services, which is provided for in separate guarantee regulations.
- USER COMPLAINTS/RULES -
CONSUMERS
- In accordance with the Consumer Rights Act of 30 May 2014. (i.e. OJ 2020, pos. 287, as amended), the Consumer may withdraw from the contract of sale of Services purchased from the Shop, without giving any reason, by making a declaration to that effect in writing, within fourteen (14) days, counting from the day of receiving the Services. In order for the Consumer to meet this deadline it is sufficient to send the declaration, before its expiry.
- A consumer may withdraw from a contract by submitting a statement of withdrawal to the Seller. A model declaration is attached as Annex 1 to these Terms and Conditions.
- The declaration of withdrawal should be sent to the address: Kraków 31- 137 ul.Siemiradzkiego 19/1 or electronically to the e-mail address houseofattractionskrakow@gmail.com .
- The Seller shall, within fourteen (14) days, from the date of receipt of the declaration of withdrawal, refund to the Consumer all payments made by the Consumer.
- The Seller will refund the payment using the same method of payment used by the Consumer. (In the event that a refund is required for
transaction made by the customer with a payment card, the seller will make a refund to the bank account assigned to the customer's payment card).
- The right of withdrawal from the Sales Contract does not apply to the Consumer in respect of the contract:
- where the object of the performance is a non-refabricated item manufactured to the Consumer's specifications or to meet the Consumer's personalised needs;
- where the object of the performance is an item that is perishable or has a short shelf life;
- where the object of the service is an item supplied in sealed packaging which cannot be returned after opening for health or hygiene reasons if the packaging has been opened after delivery;
- in which the subject matter of the performance consists of items which are, by their nature, inseparable from other items after delivery;
- in which the subject matter of the service is sound or visual recordings or computer programs supplied in sealed packaging if the packaging is opened after delivery;
- for the supply of newspapers, periodicals or magazines, with the exception of a subscription contract;
- in which the price or remuneration is dependent on fluctuations in the financial market outside the trader's control, and which may occur before the end of the withdrawal period;
- for the supply of digital content which is not recorded on a tangible medium where performance has begun with the consumer's express consent before the end of the withdrawal period and after the trader has informed the consumer of the loss of the right of withdrawal;
- The right of withdrawal from a contract concluded at a distance does not apply to an entity other than the Consumer, as defined for the purposes of these Terms and Conditions (see definition of "Consumer").
- OUT-OF-COURT DISPUTE RESOLUTION
- In the event that the complaint procedure fails to produce the result expected by the Consumer, the Consumer may make use of, among other things:
- Mediation is conducted by the locally competent Provincial Trade Inspection Inspectorate, to which a request for mediation should be submitted. As a rule, the proceedings are free of charge. The list of Inspectorates can be found at: https://www.uokik.gov.pl/wazne_adresy.php#faq595.
- The assistance of the locally competent permanent amicable consumer court operating at the Provincial Inspectorate of Trade Inspection, to which a request for consideration of the case before the amicable court should be submitted. - Free assistance from the municipal or district consumer ombudsman.
- Online ODR platform available at:

- This chapter entitled "Out-of-court dispute resolution" does not apply to one category of persons, described in these Terms and Conditions as Consumers, the so-called "Entrepreneurs with consumer rights", which has entered into force for contracts concluded since 1 January 2021. In view of this, for all contracts, this chapter shall only apply to entities belonging to the so-called category of Consumer sensu stricto.
- PROTECTION OF PERSONAL DATA
- The Customer, by placing an order, agrees to the processing, provided by him, of the personal data, for the purpose of processing and handling the order, by the Seller, who is also the controller of the personal data, within the meaning of Article 7 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), OJ L 119, 4.5.2016, p. 1-88.
- The administrator of the personal data provided by the Customer while using the Shop is the Seller.
- Personal data held in the Seller's database is not passed on to entities that are not involved in the performance of the Sales Contract.
- The Customer, pursuant to Article 15 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation), OJ L 119, 4.5.2016, p. 1-88, has the right to access his/her personal data and may request its correction or deletion. The Vendor provides each Customer with the right to control the personal data processed.
- The provision of personal data is voluntary, however, failure to consent to the processing of personal data prevents the fulfilment of the customer's order.
- Detailed information on personal data and privacy protection is contained in the "Privacy Policy" section of the Shop website.
- FINAL PROVISIONS
- The Terms and Conditions set out the rules for the conclusion and performance of a Sales Contract for the Services found on the Shop website.
- The sales contract is concluded between the Customer and the Seller.
- The Terms and Conditions are available to all customers electronically on the Shop's website at https://houseofattractions.club/.
- In order to use the Shop's Services, it is necessary to have equipment which allows access to the Internet and a web browser capable of displaying websites, as well as to provide an e-mail address for the transmission of information concerning the processing of an order.
- It is forbidden for any person, including Customers, to post unlawful content on the Shop website.
- In matters not covered by these Rules, the relevant provisions of generally applicable law shall apply.
- The Terms and Conditions do not exclude or limit any of the rights of the Customer, who is a Consumer, to which he is entitled under mandatory provisions of law. In the event of a conflict between the provisions of the Terms and Conditions and mandatory provisions of law granting rights to consumers, these provisions shall prevail.
- Should any provision of these Terms and Conditions be or become invalid or ineffective, the validity of the entire Terms and Conditions for the remainder shall not be affected. In such a case, the Parties shall replace the invalid or ineffective provision with another provision that reflects the intended economic purpose as closely as possible.
Accordingly, this also applies to any gaps in the Rules.
